1. Agreement to Terms

By accessing or using BioFace (the "Application"), you agree to be bound by these Terms and Conditions. This includes the web application, the mobile applications for Android and iOS, and all related services provided by BioFace. BioFace is a biometric port of ManpoSys, licensed to Vyakriti Software Solutions.

2. Biometric Consent and Use

IMPORTANT: By using this Application, you provide your explicit, informed consent for BioFace to collect, store, and process your biometric identifiers (specifically facial geometry) for the purposes of identity verification and attendance tracking.

  • You represent that you have the legal right to provide such data.
  • You acknowledge that biometric data is sensitive and that you are providing it voluntarily.
  • You agree that the Application may use your camera to capture and analyze your facial features in real-time or from uploaded images.

3. User Accounts and Security

To use certain features of the Application, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

  • You must provide accurate and complete information.
  • You must notify us immediately of any unauthorized use of your account.
  • You may not use "spoofing" techniques (masks, screens, or photos of others) to bypass biometric security.

4. Prohibited Activities

You agree not to:

  • Use the Application for any illegal or unauthorized purpose.
  • Attempt to reverse engineer the facial recognition algorithms.
  • Interfere with or disrupt the integrity or performance of the Application.
  • Bypass any measures we may use to prevent or restrict access to the Application.

5. Disclaimer of Warranties

THE APPLICATION IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESSED OR IMPLIED, REGARDING THE ACCURACY OF FACIAL RECOGNITION MATCHES OR THE CONTINUOUS AVAILABILITY OF THE SERVICE. BIOMETRIC MATCHING IS PROBABILISTIC AND MAY RESULT IN FALSE POSITIVES OR FALSE NEGATIVES.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIOFACE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE APPLICATION, INCLUDING BUT NOT LIMITED TO ERRORS IN ATTENDANCE LOGGING OR IDENTITY VERIFICATION.

7. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify you of any changes by posting the new Terms on this page. Your continued use of the Application after such changes constitutes your acceptance of the new Terms.
